Section 01-003  Admission Policies:  Age and Identity
Kindergarten children must be five years of age and first grade children must be six years of age on or before the 31st day of August of each respective term of school.  An original birth certificate shall be presented at the time of enrollment for entrance into kindergarten.  A child who enters school in the first grade without kindergarten experience shall be required to present a birth certificate at the time of enrollment.  A child who has completed a kindergarten course may enter the first grade regardless of age.  Exceptions to the age requirements presented above shall be allowed as follows:

A.        A.        A child who was a resident of a state other than Kansas , and who, while residing in the other state, had entered and was in attendance in an accredited kindergarten in that state shall be eligible to attend kindergarten in USD 263, regardless of age.

B.         A child who was a resident of a state other than Kansas and who, while residing in such other state, had (1) entered and was in attendance in the first grade in that state, or (2) had completed in that state an accredited kindergarten (maintained by a public school district or accredited private school), shall be eligible to attend the first grade in USD 263, regardless of age.

  USD 263 will enforce the provisions of KSA 72-5386, KSA 72-53,101, and KSA 72-53,102 which provide that whenever a child enrolls in a public or non-public school for the first time, the school board is required to secure proof of identity of the child.  Proof of identity is either (a) a birth certificate for a child enrolling in kindergarten or the first grade, a copy of the court order placing the child in the custody of the Secretary of Social and Rehabilitation Services (SRS), or a certified transcript or other similar pupil record of a child enrolling in grades 2 through 12, or (b) any other documentary evidence that a board determines to be satisfactory proof of identity.

  If proof of identity is not provided to the school board within 30 days of enrollment the school board must notify the local law enforcement agency which then must promptly investigate the identity of the child.  No person claiming custody of the child may be informed of the investigation while it is occurring. 

During the investigation regarding a child's identity, school personnel must provide law enforcement agencies with access to school premises.  Unless school personnel and law enforcement agency personnel agree that their joint presence is not in the best interest of the child, school personnel must be present at all times when law enforcement personnel are conducting such an investigation on school property.  In this regard, school personnel are subject to the confidentiality requirements of the Kansas Code for Care of Children.

  Following an investigation by law enforcement, proof of identity must still be submitted to the school office.  After the investigation is complete, the school must receive a copy of the birth certificate within 10 days or the student will be excluded until such time that a birth certificate is received.
