02-001 Number, Election, and Powers
of Board Members
The USD 263 Board of Education shall consist of seven members to be
nominated and elected by the qualified voters of the district.
These seven members shall be designated as positions 1, 2, 3, 4, 5, 6,
and 7. Board positions 1 and 4 shall
be elected from member district #1, Board positions 2 and 5 shall be elected
from district #2; Board positions 3 and 6 shall be elected from member district
#3; and Board position 7 shall be elected from the district at large.
Three of the six member district positions shall be elected at the
general elections held in April of each odd numbered year, and the at large
member position shall be elected at the general election every four years.
All Board members shall hold office for a term of four years, or until
their successors are duly selected and qualified, and said term of office shall
begin on the first day of July succeeding the election.
The Board shall have the power to fill any vacancy, which may occur in
its membership, and any such appointee shall serve until July 1 after the
following general school election. Any
vacancy occurring before January 1 of any odd-numbered year and leaving an
unexpired term of one or more years shall be filled at the first school election
thereafter, and the ballots with respect to such office shall be designated
"to fill the unexpired term". Election
of Board members shall be conducted by the Sedgwick County Election
Commissioner, who shall be the official election officer.
Candidates for Board of Education positions shall file for such office
with the Sedgwick County Election Commissioner.
Every such filing shall be made before 12:00 noon on the Tuesday
preceding by seven weeks the first Tuesday in April.
Each such filing shall be accompanied by a filing fee of $5.00 or by a
petition signed by 50 qualified electors of the candidate's member district.
No candidate for the Board shall be permitted to withdraw his candidacy
after the last date provided by law for filing of such candidacy.
If more than two candidates file for any one Board member position, there
shall be conducted a primary election on the Tuesday preceding by four weeks the
first Tuesday in April. Ballots for
such primary elections shall be prepared by the County Election Commissioner.
Duly elected Board members shall qualify by filing their oath of office
with the County Election Commissioner within ten days following the date of the
election. No person shall be
eligible to be a candidate for membership on, or to be a member of, the Board of
Education unless he is a qualified elector of the district.
Members of the Board of Education shall be paid their actual, lawful, and
necessary expenses incurred in the performance of their official duties.
