Smoke Free and Tobacco Free
Mulvane USD 263 is a smoke-free and tobacco-free school district.
The act of smoking or the use of tobacco in any form by any person shall
not be allowed or used on school grounds or within any building or vehicle owned
or leased by the district.
Appropriate student discipline measures shall be designed by the building administration and approved by the Board of Education. Appropriate measures for compliance by persons other than Mulvane students shall be designed by the superintendent of schools and approved by the Board of Education. Information about the policy to the community-at-large shall be the responsibility of the superintendent of schools. Building principals and the superintendent will cooperate to cause the placement of appropriate signs and notifications throughout the district. General media notifications and school publications will also be used to communicate the policy.
The regulations shall be adhered to and the following will be applied:
Persons
other than Mulvane students will be required to comply with the requests of the
school employees and police if necessary.
First Action: The violator will be asked to comply with the policy by a school employee by handing the non-compliant person a card explaining the situation and policy. The employee will only request compliance.
Subsequent Action: If the violator does not comply with the policy after the first action, the violator will be asked to leave the district property by the school employee or the police and told that failure to do so will result in a trespass complaint by the district.
If the violator does not leave the district property, the city police will deal with the charge of trespassing. The district will participate fully in the prosecution of the violator.
A school employee, volunteer or other officially designated person of the district that is in violation of the policy shall be verbally reprimanded in a professional manner by the immediate supervisor. Notification of the reprimand shall be kept on file. If the employee persists in violating the policy, subsequent written reprimands shall be placed on file after a conference is held and the proper notification and warnings have been issued and both parties have acknowledged the conference by signature. After three violations, the employee may be recommended for dismissal. The supervisor shall provide the employee with appropriate information on cessation programs during the discipline conference.
